You cannot apply for AOS, if your last entry to the US was EWI.

Maybe I am misunderstanding your question.

There is a way, not going to be easy. If you are EWI and want to do AOS, check out the offical I-601A thread.

Ok I was a little confuse because I keep hearing that if you apply for AOS without any daca and being EWI you can apply for AP wouldn’t that give you legally entry?
And I also here that if you have daca you can apply for AP and clear out EWI.

Anyone here from GA that has applied for AOS? How long did your app take to process? Which USCIS office was the one that they assigned you? I was assigned the Charleston, SC.

People with DACA used to be able to get AP to clear EWI. That is no longer possible. Trump closed that loophole back in Sep 2017.

Your next, and maybe only, option is to request a waiver. See:

You can apply for AOS. Having DACA or not doesn't matter. If you are EWI, you have to apply for I-601A waiver.

AP is no longer an option since DACA has been rescinded.

So daca Plus AP (I know the recindid this) you won’t need waiver or leave the country to AOS and will clear out previous EWI?

Question anyone who can answer, TIA.
trying to self file form i130, question 46d (part 4) it ask date authorized stay expired. I'm not sure of the answer. On my i94 it states date admitted until 01/01/2018. Is that the answer I should put. I had returned on AP on 12/31/2017.

Also question 48 ask for travel document number. Am I supposed to Put the numbers listed on my Advance parole document for that question of travel document number. Please answer. Tia

AOS allows an individual to apply for multiple-entry Advanced Parole(valid for 1 year I believe). However, when filling out AOS forms you declare your initial entry, where, on what status and when. USCIS WILL look this up to ensure the information is accurate via a background check.

AP no longer applies to DACA as the administration has closed that loophole and the current judges order does NOT reinstate AP through DACA.

In addition, I thought there was a loophole concerning an EWI applying for AOS and then AP allowing an EWI to possibly become a legal entrant. However, such an application would be likely be denied by fraud since you have to initially declare HOW one entered the US.
