The misinformation in this thread is amazing.

USCIS would have had no choice but to turn her over to ICE. Those with deportation orders cannot adjust status unless the order is cancelled by the issuing judge. They cannot simply let you leave if there is no legal status for you...hence they would have detained her. Thus has been going on since the days of INS.

So this is probably bad advice from a lawyer? Or she didn't know before being detained that she had a final order of deportation?
