Guys, on the I-130 from part 4 line 46.d - “date authorized stay expired” what date should be entered if we are DACA but entered EWI. Should it be date expiration date or just date of entry.

Update on this: it looks like the lawyers are trying to use hardship for my grandma and my mom needs to be here to support her health wise and financially. They're working on putting together, collecting letters and proof of support to build the case and waiver.

Sigh, so nervous.

That section applies to you only if you were inspected into the country. In other words, if you were legally admitted into the country.

If you EWI, you'll want leave that blank. See screenshot.

Marriage to an USC is the only guaranteed way to adjust if you EWI and don't have waiver through I-601A or 245i.

Yeah, that is what I figured.

I might be going this route in about a year. How long on average does the process take?

Assuming that your case is straightforward. Meaning, no issues with the law or in removal proceeding. The process, from start to finish, will take around 2 years.

There is A LOT of sitting around involved in the process waiting for one form to get approved before you can submit the next one, so get started as soon as you can.

I'm not sure if this was already discussed in this forum but those who EWI and got DACA before 18yrs old and had no lapse and have an approved i130 can go to their home country for interview with no waiver needed. A lady in FB group was approved on her interview at Juarez, Mexico.

Sorry, could you clarify that a bit? I am an USC and my wife is a DACA recipient that also is EWI.

I thought the only way to get her an adjustment is through the i-601. Are you saying there is a simpler way for us or am I just misunderstanding this.

Sorry, you are right in that you need the wavier using I-601A or 245i if you EWI.
