Gov't argument via @shobawadhia:

3/ gov't argues end of DACA cannot be reviewed by a Court and finds is compatible with the choice by the Fifth Circuit to review #DAPA because the latter "exceeded" legal authority. gov't says it is okay to have a "zero tolerance" policy on immigration enforcement.

4/ Govt argues DACA is unlawful and not a permissible use of enforcement discretion. For a contrary (and the prevailing) view, read a letter by 105 scholars familiar with the immigration statute here:

5/ Govt argues it is actively considering whether to change the DHS rescission memo in light of the DC decision (third court on DACA who asked the govt to issue a explanation in 90 days)

6/ Govt presses on how the DACA policy does not include #costs when discussing legality For a countervailing view read about the enormous economic contributions of DACA recipients by @CAP

9/ California- rightly points to the thin (no?) analysis by DHS in why it had to end DACA. They cite only another case (DAPA), ignore the 33 page OLC opinion and avoids the more than 50 year history of #deferredaction in immigration law

10/ CA on reviewability - decision to end DACA is not like decision to not enforce or enforce the law in a particular case. It makes no sense that a court is powerless to vacate a decision found to be invalid.

11/ CA- if the court concludes the rationale by DHS to end DACA was vague that is reason enough to set aside the policy

12/ CA- DHS failed to consider the welfare of the 700K #DACA recipients, their families, employers, schools and economy. (Anyone who has or known a person with DACA has tasted this human impact CA brings out in the courtroom).

Quote:
15/ Govt Rebuttal: focuses on reviewability - frames choice to end DACA as a choice to "enforce" the law and thus unreviewable in a court. Restates DACA and DAPA are indistinguishible. On EPC argues no proof of animus by DHS. /END

"These individuals were used as bargaining chips to try and pass other policies. That's not going to happen to Norwegians" - Mark Rosenbaum on arguing against Trump's decision to end
The arguments are over now. The government was also complaining on how they are *forced* to keep reviewing applications for renewal. He made it sound as if this was some terrible burden they had to bear.

apparently when the SC rejected the administration's direct appeal trying to bypass the lower courts, they said they expected the lower courts to act promptly... so I can't imagine it taking months... probably looking at weeks, but I dunno what the judges will do.
