Therefore, as per the state law, if the feds do not recognize one as a 'legal resident' they cannot receive in-state tuition. The schools were arguing that one's acceptance into the DACA program bestowed upon them 'legal resident' status for the purposes of the law, while the state was arguing it did not.

The state argued the same thing with driver's licenses and they were rebuffed.

Damn even in TX we had in state tuition prior to DACA. Only way I was able to afford it. All you needed it was a waiver and 3 years of HS in the state.
