This is a different story, but nearly identical problem. Her parents probably brought her in at a very young age, left, and then came back again. When she left for her visa interview, she triggered the "permanent" ban.

My guess is she didn't know, her parents didn't tell her, and the lawyer just took her word for it, but should have double checked.

I also had an encounter with CBP when I was a minor, but I was able to request my record from CBP where it says I was given "Voluntary Return", which does not carry the penalties that do come with an "Expedited Removal".

I'll have my visa interview in another 6-8 months.

This doesn't really belong here.

It's not news per say. There's a lot of stuff that is being left out. I'm more than sure she has other stuff that is making this a complicated special case.

I smell something fishy...

how do you request that record?

And to OP i thought AP doesnt clear EWI anymore????

It’s call a FOIA. You can submit the CBP foia online, you can also foia USCIS/ICE.


What we are doing at my office is requesting AP for DACA ppl who are attending their visa interview, so that have the option to come back using that. Y’all also have to realize a lot of these people aren’t fully aware about their entries and 90% of the time the parent ‘forgets’ something and without you disclosing a complete history of entry, attorneys will go by the info given.

How do you manage to get it for the date that you need it? Because I know my interview is coming up, but it wont be for another 4-8 months.

Have you had any luck with your clients doing an InfoPass to request an AP on the spot?

Don’t mail it off, instead call USCIS tell them you want an emergency info pass, they’ll tell you an officer will call you back within 15 days to schedule. They usually call 1-3’days later, then that officer that calls will schedule you for an info pass for the next day business day.

You show up to info pass with your I131, docs and filing fee and an officer will take everything and issue you an info pass valid for 90 days.

I'll have to try that. I recently submitted my DACA renewal... another $500 will hurt my wallet, but probably worth the peace of mind.
