If your lawyer fucked up and checked that you'll apply for AOS then you'll have to file I-824 to forward the case to the NVC.
Called NVC with my approved 601A receipt number and they told me they could not help, that I at least needed the I-140 receipt number. asked the law firm to provide it, they didnt, they said "please wait and once we hear from NVC we will of course update you".
Another outside lawyer I paid $250 and wasted one afternoon to get a second opinion actually said the same.

@Demise @MIdreamer @trac3rt and @nydreamer 's advised I insisted with my HR to get me the I-140 receipt number. Finally got it called NVC Friday and today, got through today 6/21/21 and both my company's lawyer and outside lawyer were WRONG!!!

NVC told me that it’s waiting on us (company lawyer or me ?) to go ahead and file the DS-260 and submit the civil documents to close the case and put me on the queue for consular interview. They said they received the case back in August of 2019, were waiting on the approval of 601A which they received 6/2/2021 and are now waiting on use to complete the DS-260 on the CEAC website.

They send they email the firm our invoice and case numbers back in 2019. She provided the NVC Case number and Invoice number to ME yay!

Now the question I have is (and posted to the lawyer too, he will respond in 3-8days) Can I go ahead and complete the DS-260 NVC is waiting for ? Or do I have to wait for the lawyer to fill it out for me? I just don't want to mess up my case and give the firm to say I am messing up the process.

What has been your guys' experience or know about this?

and thank you for all your responses, if it were not for the info you guys have given me here, id still be waiting for God knows what still. My case I-140 employment based plus 601A started back in 2017 and has been delayed several times for multiple reasons.

The DS-260 is your form, so you can fill out and submit it on your own.

thanks for the reply I will go ahead and start filling it out . If my company's law firm says otherwise later on, they can always correct it afterwards and do it themselves. I supposed once I start going through the DS-260 it will tell me at some step what civil documents to submit and don't really need the lawyer to give this list, it comes from NVD anyway. My consular processing will be in Guatemala's US embassy so I am checking the list of documents specific to this country.

Thank you, I got the attention of my company's lawyer now that i got this info from NVC , He is not too happy that I called NVC and now im kind of saying he is basically wrong to keep asking me to wait on some notice from uscis. I will hopefully get on a call with him tomorrow and be able to explain this without getting confused by them.

I had similar problems with my lawyer; they do not like it when you get in their business but I've found you really need to be proactive about it. I know they hate it, but if you're not on top of it they might not either.

Glad to hear you're back on track! I would work on filling out the DS-260, but don't click submit on the last page. Give the lawyer a chance to review it.

Good luck!

Good luck! I'm hoping to submit mine soon, just waiting on my dad to get a better doctor's note next week, the one he originally got me was wonky.

I ask my company to write a letter saying I need to make multiple trips between Dec 2020 and April 2021 for business purpose.
