I think it says she had a petition? Maybe some sort of private bill for her. She also likely already held a green card. In any case she likely could get a green card the way John Lennon did off her musical talent. Literally just an application lol.

The gold card looks so tacky. I think they put these inside the willy Wonka candy bars in that movie and in teal life.

My guess is that at the present it's literally a piece of plastic with Trump's ugly mug on, a preorder for something that won't ever come out.

The only real basis for its existence is EB-5 with lesser basis in EB-1 by having the company you bought into sponsor you as an executive (which is a major stretch if you won't be sitting in any boardrooms).

In this case, EWI and prior unlawful presence would still be a factor. Maybe you could make some weird argument around a grant of nonimmigrant status of some sort while in US followed by 245(k) but that's about it. In her case maybe she could do an EB-5 and I-601A through her husband?

Oh and why doesn't her husband just file an I-130? Because he's barred from it under the Adam Walsh Act.

Straight up immigration pardons were never legally tested. The ones that had immigration applications generally happened as a side effect of some criminal pardon. Then there's the other problems in that it'd wipe away prior immigration issues but would do nothing going forward (pardon doesn't magically give you an admission into the US).

In her family cases, hubby got convicted on state charges in NY and CA, brother got convicted on state charges in NY. Presidential pardon wouldn't do anything.

Hell, Trump tried to pardon that woman who went to prison in CO due to the fake elector scheme and she's still sitting in prison because CO doesn't care about a presidential pardon.
