Well obviously since theyre parents of a USC they will be included. Theyre not going to exclude them only because they have a child whos DACA.

Exactly. If you have a USC/LPR child, regardless of the immigration status of your other child (or children), you would qualify.

My question to you is, when is the LAST time you entered the US and is it stamped on i94? All I am saying is the reason you were told you're not eligible is not the reason. It's not even a requirement actually. You don't have to "establish residence before 16". You have to just enter before 16. Now if you traveled out after turning 16, the I will be honest I am not an expert on that but other than that the above requirements are the only thing you need to focus on.
The last I-94 i have is dated June 2004. However, right before i enrolled in school in 2001, there are multiple recorded entries dating all the way back to when i was an infant. That is the problem. I was in and out of the country ALL of the time, but it wasn't until i enrolled in High School (January 2001, when i was already 16) that i can prove i actually meant to stay. This is what "case by case" means. I can essentially argue that i entered the country when i first got my BCC and i was like 1 year old. This is the problem with my case.

Dude, trust me, i tried. I dissected this shit from every possible angle. Consulted not one, but multiple lawyers.
