Regardless of potentially creative arguments for standing, yes, the federal government will be the party that appeals this (if they do at all). But there may be some political reasons for appealing. The Justice Department is not above pulling something like that to kick the decision back to Congress. (Could be an argument for "political question" here since it's an administrative policy).

they won't have to.. Elections are next month.. Don't they have 60 days before anyone Needs to appeal?
