Neither do I and since Hanen fully intends to keep everyone in infinite limbo just because it's fun I am completely stumped. It is mind boggling to me that he can set his own timetable for a decision without any repercussions. Why isn't Obama using his authority to ensure he does make a decision. Is the 5th circuit a last resort only? No clue.

5th circuit, then on to supreme Court if no favorable outcome. Im not excited about 5th circuit court ....the judges are all mostly conservatives.

hmmm. And the Question that Hanen brought up was that the Executive Actions were unlawful because they did not comply with the Administrative Procedures Act for rule making and public comment. With that argument, it could be easier for (any) judge to say, well that may be true instead of asking if the actions were unconstitutional outright (which they are not).

This is a clusterf***k.

When a case is pending like this. Litigants can ask for a stay from the judge pursuing the case (Hannen) and/or ask a superior court for a stay (5th Circuit).

I'm not sure if the administration pursued an emergency stay (unlikely since I haven't come across it anywhere) with either Hannen or New Orleans 5th. That means it'll probably be weeks before the 5th Circuit will consider the request for a stay and doubtful that Hannen will stay his own injunction.

As was mentioned before, it can be a real f up if Hannen is looking at running out the clock by not deciding on this case and letting his injunction stand. The only way forward is for the 5th Circuit to remove the injunction in the coming weeks. If they don't then it'll stand until a decision (if it ever is) made.

This was pure grandstanding by Boehner, and would not really affect the executive action as far as applications since the fees they charge us already pays for the process. The real threat to the expanded DACA and DAPA program is this stupid injunction thats stopped it from going into effect.

^^ Exactly. A bill was passed without any immigration restrictions because Boehner knew he had the injunction in his back pocket and Hanen had no intentions of finalizing a decision. I'm just shaking my head when I read articles that he "caved" on immigration. He never caved it was all smoke and mirrors to begin with. Right now expanded DACA/DAPA is stalled indefinitely.
