He has already been deported twice this makes his case even trickier
Quote:
Montes said he was jumped from behind, mugged and beaten. At that point, he decided he needed to get back home. He saw some people using a rope to climb over a section of the border wall and joined them. He was quickly captured by federal agents, questioned again and deported again.

Basically he signed away his rights voluntarily and left US without AP. And got caught trying to enter illegally.

Difficult legal situation.

He's done

He decided he needed to get back home. He saw some people using a rope to climb over a section of the border wall and joined them. He was quickly captured by federal agents, questioned again and deported again.

Correct me if I'm mistaken, but wasn't shoplifting a priority 2 for deportation, even under Obama? These guys seem to not care one bit about it. Anything goes. Nobody is spared. I really do wonder what's going to happen to DACA people with old convictions.

No shoplifting has never been priority 2 for deportations unless it was an aggravated felony or burglary. On the other hand DUIs, domestic violence, and drug related convictions had been priority 2 under Obama

I feel very sorry for this guy. Trying to re-enter illegally has made his case so much worse. After finding out about his mental problems it is easy to imagine how he was bullied and scared into signing his deportation docs. I wish there was something that could be done for his case, but with two deports on his record things look really bad for him. I hope his attorneys are able to prove wrongful deportation and then attribute his attempt to re-enter illegally as "fruit of the poisonous tree" or something, but I'm not sure if that legal concept would apply in his case.

This really sucks though, I feel so bad for him. People living that close to the border need to be extra careful. Always carry your EAD and NEVER sign anything ICE gives you.

Maybe I read an earlier version bc going back now, the memo. That's on ICE, it Jo longer mentions hit and run as a significant misdemeanor, whereas before it did. I also remember ICE attempting to deport a woman from Argentina claiming she shoplifted something. It turned out she forgot to pay for an item, or something like that. Maybe I'm crazy. Continue on. Haha

How can so many things go wrong.

1. Stay away from border areas if possible. He didnt.
2. Carry EAD at all times. He didn't. (at least have EAD picture on your phone)
3. Don't sign anything ICE forces you to. He did. (wait for a lawyer)
4. Don't cross the border illegally. He did.

I remember having this discussion on this very same website about whether or not to carry your ead. I always said you should have it because you never know when the shit will hit the fan (work raid, wrong place/wrong time, etc.) but a lot of you people said "That's stupid, what if someone robs you or you lose it?".

This is my official "I told you so!".
