For that, you will have to prove that your US citizen or LPR child, spouse, or parent will suffer from your hardship if you're deported. It typically only works if your loved one is suffering from some bad disease or disability and cannot be treated in your country of origin. I heard they only grant 4,000 green cards per year for those types of cases.

Well I have custody of my step child who is a us citizen under court supervisions and professional therapy due to his mothers neglect. Would that somehow count?

Probably not unless he's diagnosed with some serious mental issue. It also depends on your country of origin. You should consult with an immigration lawyer about this.

I'm from Afghanistan and no it is extremely difficult to get asylum. Also, the bad thing about filing for asylum is that if you get denied, they issue a deportation order against you. Filing for asylum is not like AOS through other means.

The reason I'm in this mess currently is because of a failed asylum case. It's extremely hard.

Asylum cases are extremely difficult to win. You have to prove that you are truly under threat of returning to your home country.

You can't just tell them that you are scared of drug cartels, or poverty, or whatever. It doesn't work that way.
