DACA was implemented as a substantial regulation, which as per APA has to go through a 60 day comment period. So it was announced June 15, and opened up 61 days later on August 15.

Forms were leaked a few days early. Hell, forms won't be that fucking hard to get out, could recycle half the stuff from I-821 and I-821D, and just require I-485 to be filed with everything.

Personally I expect to have to file between 1 and 4 forms. Since DA also authorizes cancellation of removal there will probably be two different forms for USCIS and EOIR, tentatively lets call them I-822 and EOIR-42C. They might also require an I-485 to be filed as well, with optional I-765 and maybe I-131.

Overall it's difficult to gauge from the text since it doesn't amend INA unlike most other immigration acts, instead it stands on its own alone. Which means that adjustment under Dream Act would not be a section 245 adjustment, as DA adjustment would conflict with 245 adjustment due to requirement to have an immigrant visa and visa number readily available, DA skips those. (Fun fact, Fiance Visa adjustment is also technically not sec 245 adjustment).

I am not sure how it works but shouldn't be easier for us to be approved since we are technically already "in the system"
We already have been through biometric, background checks, SSN etc.. I mean USCIS knows me a whole lot better than my girlfriend.

It will be as fast as renewing DACA was, perhaps slower due to physical checks. So it will go something like:

* Fill-out forms
* Bio appointment
* Health exams.
* And a few months wait for approval.


Disclaimer: I might have no idea what I'm saying.

Nobody knows the process yet so pointless to get ahead of ourselves. Assuming something passes (big assumption), some people WILL have some lapse in their DACA (EAD/DL) coverage but again, lets keep in mind the long term goals.

2-4 months for forms to be available, good. if it takes 6-8 months to get the form ready, well, fml.
