US judge blocks Trump's order curtailing birthright citizenship - Page 2

I think the Supreme Court is likely to agree with Trump. Apparently the original intent around it was that it was supposed to apply to slaves. In its original context it was that Native American tribes were outside of Jurisdiction but were granted citizenship.

The constitution should be interpreted literally, reaching back in time to recontextualize is just that, a reach. Are the parents within the jurisdiction of the US, yes or no? Yes. Apparently they want to exclude visa holders, but they are even more under the jurisdiction of the US.

In several articles, Trump knew that this would get challenged and struck down so his goal was to get it before the Supreme Court. The SC would then strike down the blank EO but give some kind of guidance on why and how the court interprets the 14th. With this information, the administration would be able to craft a 2nd EO that has a chance of passing.

There's no EO or Court decision that can eliminate Birthright Citizenship. The only option they have is to modify the Constitution via legislation in Congress. There's no other way.

There are also no rulings or legal precedence regarding birthright.. those are the first steps to making changes

Very true. It doesn't matter what it says. What matters is the controlling interpretation and context. Unfortunately they want to redefine who is under the jurisdiction of the US.
