N GENERAL
.—Any alien

who has been convicted of a crime of
10
domestic violence, a crime of stalking,
11
or a crime of child abuse, child ne-
12
glect, or child abandonment, provided
13
the alien served at least 1 year impris-
14
onment for the crime, or provided the
15
alien was convicted of offenses consti-
16
tuting more than 1 such crime, not
17
arising out of a single scheme of
18
criminal misconduct, is inadmissible.

‘‘(II) C
RIME OF DOMESTIC VIO
-
20
LENCE DEFINED
.—In this clause, the
21
term ‘crime of domestic violence’
22
means any crime of violence (as de-
23
fined in section 16 of title 18, United
24
States Code) against a person com-
25

mitted by a current or former spouse
1
of the person, by an individual with
2
whom the person shares a child in
3
common, by an individual who is co-
4
habiting with or has cohabited with
5
the person as a spouse, by an indi-
6
vidual similarly situated to a spouse
7
of the person under the domestic or
8
family violence laws of the jurisdiction
9
where the offense occurs, or by any
10
other individual against a person who
11
is protected from that individual’s
12
acts under the domestic or family vio-
13
lence laws of the United States or any
14
State, Indian tribal government, or
15
unit of local or foreign government.

EFINITIONS
.—In this section:

‘‘(1) F
ELONY
.—The term ‘felony’ means any
1
criminal offense punishable by a term of imprison-
2
ment of more than 1 year under the laws of the
3
United States, any State, or a foreign government.

‘‘(2) M
ISDEMEANOR
.—The term ‘misdemeanor’
5
means any criminal offense punishable by a term of
6
imprisonment of not more than 1 year under the ap-
7
plicable laws of the United States, any State, or a
8
foreign government.

‘‘(3) R
EMOVAL
.—The term ‘removal’ includes
10
any denial of admission, exclusion, deportation, or
11
removal, or any agreement by which an alien stipu-
12
lates or agrees to exclusion, deportation, or removal.
13
‘‘(4) S
TATE
.—The term ‘State’ means a State
14
of the United States, the District of Columbia, and
15
any commonwealth, territory, or possession of the
16
United States.’’.
