2) Get married and apply for 601A waiver he will be able to do all the process here and just leave the country to get his visa.

The only way he will be able to adjust here w/o leaving the country is if he is covered by 245I. Find out if by any chance he has a pending petition on his parents side. This petition must be before April 30 2001

Between june 2007 through june 2012, if your departures were briefly and innocent, it doesn't affect you.

By briefly, it means that you went out for about a week to visit family or something.

Through those years i went out 5 times, a week each time, just to visit family. I heard they will only ask for an RFE if you went out daily.

I never went out after june 2012, which if you did once, you don't qualify.

I remember some chick in here went to italy for 4 months, and she still qualified, then another person did a semester in mexico, and got denied. it depends alot on the person doing your case.

I was finally approved today, it's been almost 8 months since 1/23. Just wanted to update you guys.

keep hanging in there. and a word of advice, don't be rash in asking your congressman for help. they might not know what they are doing and pull your case out of the system, like mine did. I had to track it down myself at the local field office. thankfully an officer was nice enough to hear me out and she contacted a supervisor over at the CA service center to explain my situation, and the other officer agreed to look at my case as soon as it was transferred back. and now it's finally approved! thank God
