They should NOT get approved, since that's what it says on the USCIS, which I won't quote because anybody can look it up.

So I emailed the Nebraska SC follow up email and this is what I got:

I was charged with a DUI almost 5 years ago...however some attorneys don't recommend me to process..Recently an attorney said for me to give it a shot..I'm just a not sure..although it specifies that a DUI disqualifies you it also says that cases are handled and review individually...after reading the discualifications it says:

Notwithstanding the above, the decision wether to defer action in a particular case is an individualized, discretionary one that is made taking into account the totality of the circumstances. Therefore, the absence of the criminal history outlined above, or it's presence, is not necessarily determinative, but is a factor to be considered in the unreviewable exercise of discretion.

I completed every thing court wanted me..i don't know what to do!!

Well I don't think you should. An immigration officer is gonna see that you have a DUI and deny your case and it will be a waist of money.

Hi all! I got approved! Here's my timeline:
Sent application: June 18, 2013
Application received at NSC: June 20, 2013
Biometrics Appointment: August 1st, 2013
Request for Evidence: October 2, 2013
RFE received: October 16, 2013
DACA/EAD approved: October 28, 2013

I'm pretty grateful I receive everything in almost less than 3 months (since they don't officially look at your case until after the Biometrics ). I start college at FIU this January and will be dorming! I'm looking for work now in the meantime while I get my SSN and DL. Thank you all for all of the helpful posts!

dont be discouraged seriously , check your record if you complied with everything and it was your first offense im pretty sure that dui either tho got reduced to something else or is probably not on your record anymore , if it is you can have it get expunged by the courts , then you can apply , and yes there has been people with d.u.i. cases approved of course they pleaded down to something else but nevertheless they git approved theres been several cases like that not just one , so again dont be discouraged its all in the details p.m. if you have any questions , and again check in the details of your conviction
