I spoke to my supervisor since I only have two weeks before I expire. She told me if I get approved, a notice will suffice but the DACA notice specifically says it can't be used for employment authorization - I haven't told her this but I knew I wouldn't get approved in time anyways. They will have to terminate me by the time I expire and rehire me as soon as I get approved. It's good to know that they're being supportive but it's hard since there is no way of telling how long this will take.

Why are you guys being terminated? I'm just going on an unpaid leave. Our firm's lawyer said that's fine.

It depends on your employer and I'm employed at a public institution which makes me technically a state-employee, therefore they have to be more strict.

Carnivore, you cannot be on a company's payroll if you have no authorization to work.

Update on my situation: they decided to keep me on stipend (I work at a nonprofit). I'm going to take a huge pay cut because they cannot pay me at the same rate, but at least I'll have something come in. Once I get my approval, I can come back to my regular rate. I hope I get my permit soon, that pay cut is big. Guess I got lucky after all: this is the first time I work in a nonprofit... I probably couldn't do this type of thing at a regular company.

You can be off the payroll and not be terminated.
