@KarenTumlin
My take on @TheJusticeDept's late night Friday filing in the TX lawsuit challenging DACA:
It's no surprise that DOJ tells the court it thinks DACA is unlawful. Reminder: this is the same administration that ended DACA w/o a coherent legal basis & w/o care for #DACA recipients. 1/

The only surprise is how DOJ lays out its plan to use the order it hopes will result from the Texas court to sprint to the Supreme Court with the goal of shutting down "all" court orders on DACA--namely those issued months ago from courts in CA & NY protecting DACA. 2/

This entire case by TX is shameful. If Texas had something to say about the legality of the ending of DACA, it could have weighed in during the proceedings in CA & NY months ago. /3

To DACA recipients across the country: we see you & we stand w/ you. @MALDEF is fighting in the TX court on behalf of 22 DACA recipients, @NILC @MaketheRoadNY, @WiracYls & so many others including 20 states are standing up w/DACA recipients in other courts across the country. 4/4

In the event that the court does grant the injunction, the Justice Department requested that the order be stayed for two weeks to allow it to seek emergency relief of the other injunctions. “A stay would facilitate the orderly resolution of the litigation over the DACA policy,” it said in its response.

So what is the play here? After Hanen rules against DACA they want the injunction to be stayed for two weeks so they can go to the Supreme Court again to get all injunctions nullified?

That's what it sounds like. I honestly think, it's an effort to back Dems into a corner to accept the Shitlatte bill in the next few months.

Although the Justice Department does argue "that courts have typically held" in "similar situations" that "the appropriate course is for a district court to refrain from issuing a conflicting injunction," DOJ nonetheless goes on to offer its view on what Hanen should do "if this Court decides that preliminary injunctive relief is appropriate."

Maybe. Maybe even approved renewals are toast. Maybe neither are. No one knows.
