Interesting development for the enlisted MAVNI's, USCIS just released a memorandum stating that they can apply for Deferred Action. Mainly geared for out of status F-1/other non DACA enlistees who went out of status after enlisting.

Also allows family members (parents, immediate family) to apply for it as well. Meaning any DACA MAVNI enlistees can potentially get work auth for their parents, essentially DAPA but for MAVNI's only.

This could very well get rescinded in January along with DACA, or maybe not, either way another avenue for you MAVNI's. It could serve as helping your parents in the meantime, or a potential fallback next year if this memorandum stays.

Can you supply a link please. I am interested in the parents section, does this apply to those who haven't shipped yet?

This is a tough decision to make. Anyways would we be able to give the same benefits to our parents even those they're undocumented as well? And is it worth applying for (I just got my DACA approved 2 months ago) if you're going to apply for green card for them once you get citizenship?

It's really just a temporary work permit for all parties involved until we naturalize and sponsor them formally. Not sure what happens to beneficiaries once we naturalize though, it might end, or it could be valid until the sponsorship goes through.

I haven't read the memo in detail but the gist is it's created to alleviate those out of status and have enlisted, and indirectly us as well if we lose DACA/have immediate family members who are out of status.

Not being selfish but I wish there is a more streamlined instructions rather than just saying to 'write a letter' to get our parents deferred action too, who in here will be taking advantage of this? Will you lawyer up?

it should continue on until they get their GC. plus, applying for DA is free just write them a letter, which they might put it in more details later, and apply for I-765 if you want to get them EAD.

In my case my parent is a citizen, the other parent lives abroad, so nothing for them really. I'm just considering this as a backup if DACA gets canceled, I can jump on this DA(without the CA).

Do you guys recommend MAVNIs to go to drills even though the ship date got pushed back to late next year? Or does it still not matter whether we go or not?
