When you applied to DACA, you admitted to being illegally present in the US and the US government agreed to not persecute you for deportation. In other word, you are guilty but the government will waiver persecution. This changes under Trump administration.

This is different from illegally present in the US but never admitting to it; then you are not guilty until an immigration judge finds you guilty of an illegal presence after a trial.

Yeah and we are set for deportation it would be hard to built a case to remain here since we already admitted guilt.

Yes, that's the killer part; every single DACA applicants admitted guilt on immigration crime, hence the easiest target to go after if the Trump administration decided to double deportation number to 700K per year to meet the quota of 3 million deportations during Trump's 4 year term.

I know this is screwed up.

And as everyone knows admitted guilt is the worst you can do. So we are easy targets.

The best outcome is what IRS does with us

"FOR tax purposes everyone is a PR / has legal status"

Trump can just do the same

"For deportation purpose, a criminal is so so but DACA is not subject to criminality"

Sounds similar to entrapment to me...how will that fly in court?

Not saying we have much say anyway...just saying...

Really entrapment ? USCIS didn't hand DACA knowing trump would win. No one forced to get DACA. I have friends who still haven't gotten DACA and now think they did the best choice.

Not saying it is, just somewhat similar to entrapment. We were given an opportunity, but the caveat is we give our information and admit guilt, but are promised that it won't be used against us...but then a new President administration uses that same information to take us down.

Not exactly like entrapment (As described in law)...but still kinda like it IMO.

Nevertheless, what we think doesnt mean much at the moment...we have a Trump presidency to deal with for the next 4 years one way or the other.

Also, I'm gonna play Devil's Advocate here.

I can understand not applying for DACA now, but they should also brace themselves for a possibility that Trump keeps DACA but only for current beneficiaries, and any new applicants are locked out (Until a new president reopens it or something).

And this actually makes more sense for Trump's "plan" to put things in limbo so "we can figure things out" while he carries out his deportation movement. He plays one side that he didn't take away DACA for current beneficiaries, but doesn't allow the number of beneficiaries to climb to appease the other side...and then he basically doesn't touch on the subject for another year or so while he figures out what to really do.

So everyone needs to really really think carefully about every possible scenario.

Chill out, when he talks criminals he's talking murderers, drug dealers etc. No way he includes us in that. The backlash would be insane. Use your noggin boy. Most people feel sympathy towards our cause, which greatly helps us.
