I recall reading somewhere, that if the court throws out this DACA amendment, that there is no guarantee a refiling of the suit will go to the same judge/court. I can't find the link to it, but in my opinion, Paxton may know that if it gets thrown out and he tries to refile with another court, it may not go anywhere.

You can have your opinion but at the same time you're shouting down other people's opinions and telling people everything is fine when there is a very real potential for DACA getting rescinded or stopped by an injunction.

There is some grey area between panicking and being in complete denial.

I'm not a lawyer so if you are, I'll give you the benefit of the doubt that you know what you're talking about but throughout the DAPA court cases, there was someone else on here that sounded an awful like you do who claimed that the whole thing could be resolved if only Obama would have done this or would do that and essentially claimed to know better than a Harvard Lawyer and the entire justice department.

If you're NOT a lawyer then your opinion has enough weight behind it as anybody else's. All I know is I listened to the 5th circuit and read the SCOTUS arguments and the majority of the discussion was about how much Texas didn't want to pay for driver's licenses and any constitutional issues were on the back burner.

Even if you were right, Hanen doesn't give a crap. He can put an injunction on DACA and ask questions later and where will the appeal be? At the 5th circuit again. If it ever does go to SCOTUS, Kennedy if he's still around might help...or he may chicken out like last time.

Late 40's Dreamer (Holy Fucking shit I'm almost 50 and still dealing with this), aged out of original DACA and didn't have a chance to apply for extended DACA after Republicans killed it on the vine.

Yeah, interesting and applicable to our case. The difference I see is parole vs. deferred action. Was this cited in a discussion about DACA?

DACA is constitutional I believe. What is going on is merely politics. I believe the main consideration the Trump administration might be evaluating is whether standing up to the challenge would yield a spike in popularity among centrist and more liberal republicans. In a way, keeping DACA would shut the leftist argument that the administration is committing atrocities. Keeping DACA allows them to justify enforcement only measures.

Rescinding DACA gives the Left a political gift. If I was Bannon, I would be thinking about this, the guy is twisted.

I don't know if it was cited in a professional discussion about DACA. Someone posted it on twitter, so I don't know where that person originally found it. There certainly are differences between parole vs deferred action, but it shows Presidents in the past have used executive power to help small groups of immigrants.
