From what I have read in the articles, it seems certain law enforcement were testing the protections very early in the year.

However, the immigration enforcement cannot simply take away protections. They require certain charges to render your protections obsolete. The court cases early this year have made that so.

1.The way how it works is agent accuses you of a crime(whether lie or real), renders your protections obsolete, then detained.

2.You cannot be released unless you have access to a status(within six months typically{e.g.pending adjustment, U visa, T visa, Asylum}) or there is significant public interest within your case. This administration has ended release. There is almost a guarantee of being detained if no status is found at the time of interview/interrogation by law enforcement.

3.The only thing that has not been tested really is the promise of USCIS not using our information for law enforcement purposes unless moral character has been violated. We still do not know how a court would rule on such issues. However, I assume in the strongest possible instance this is why the Federal Judge re-instated DACA for those to renew.

Uscis said they shouldn't share information with ICE but this means a lot of things. From my understanding, uscis won't share our info with ice UNLESS Ice asks to see that info. Remember that ice, uscis, cbp all fall under DHS. Uscis made the promise they wouldn't share our information on their own unless they denied us for serious crimes. But they never said they wouldn't handle it to ice if ice asked for it.



Ice has detained DACa recipients before and released them but the fact is, even just an acccusation is enough to warrant Ice to detain us. And you don't get put in a room alone. You are asked questions left and right. Ice won't simply let to because you have DACa. They will dig for anything to use as reason to deport you and if they can't find anything then yes they will release you
