As of now, I think processing the waiver takes close to a year? So I won't be seeing her for that long, and that's if it gets approved. Obviously I cannot leave to go see her.

I am horrified and heartbroken. I got so dizzy hearing the news that I almost fainted.
I'm sorry about the bad news. So the lawyer did not mention about the smuggling possibility may came up during the interview? Coz there were a lot of stories about these on the Fb group.

From what i read, applicants were able to request an expedite on the 601waiver due to medical emergency and was able to come back earlier in the US. Please check with your lawyer. Also join Fb groups on 601 waiver since they have more experiences and can give more tips.

Well when they asked for the Foia, it only showed 1 entry. (In reality they know they made 2 entries so they thought they were safe.) But when they were interviewed at the consulate, somehow it showed the 2 entries so they got denied. And some people who did not get a lawyer didn't know that they get banned for double entries, probably they were ill advised by friends.

I will find out more info about the smuggling question soon.

I’m not active on Facebook but will look into it. Are there successful cases of the I-601 being expedited and/or approved?

Thanks for the screenshots! Makes me feel hopeful that this will be resolved in less than a year.

I wish I would have seen this earlier. I'm a nobody, but I would have told you to not let her go because I keep hearing about people being denied for this very reason. They're ramping up denials for people like your mom right now.

Bummer.

Today she is leaving Juarez and will fly to Tijuana where immediate family will be waiting. That will put me at ease a bit more knowing she's safe.

We will begin the process of filing the I-601 waiver immediately and hope that my grandma's condition will allow us to request the waiver to be expedited.

But as of now, I'm conditioning my mind to accept the fact that I will likely not see her for a year. That is heartbreaking.

It is such a painful experience but don't let our situation sway you. Every case is different, as are the agents.
How come they are showing 2 entries for her and what is their source/evidence? You were brought here as a minor as EWI (That is another story). What are lawyers suggesting?

FOIA is proof that there was 1 EWI. How did they come up with 2 and did they show you the date? Double EWI is Permanent Ban and you can't even apply to get considered to come to USA in 10 years. Never do this without an experienced lawyer (Just my opinion).

Most cases seem to get approved for I-601. You should join that FB Group.
