If the parent is a USC and the overstayed son/daughter is over 21 then what is the benefit? Son/daughter gets a waiver for the 3/10 ban? Can stay in USA and wait for the Visa? What if the son/daughter also benefits from 245i?

What happens if your waiver is not approved? Im going to get married soon but what happens if i cant prove my wife will suffer extreme hardship if i leave?

Who wouldn't suffer extreme hardship if their husband/wife gets deported?

My grandparents are USC but my dad and I are undocumented but we flew here about 6 years ago.

If this changes goes effect, Can my dad apply for visa/waiver? without leaving this country?

Or If USCIS let my dad to process his visa, does he have to wait to get the valid visa? which can take up to like many years?

I wish it was that easy. You are right, who wouldn't suffer? The problem is what they believe to be extreme hardships.

So if my dads brothers are us citizens then my dad doesn't qualify for The waiver?? Only spouses or children ?

Exactly,not to mention the person or persons would have to tell a unique story considering many immigration officials read plenty of stories concerning just 'hardship' that may not be 'extreme hardship'.

Did he file the 1-130 and is he current in the visa bulletin?

If not, he will have to way 10 years, I believe 19 if he's from Mexico.

Spouses and children are immediate preference, and parents too.

No he hasn't filed anything. So can it be possible for my uncle that is a us citizen to petition for me somehow??
