At least you know it's approved. Your employer won't be okay with the notice of approval? Or any info re: delay of card delivery?

nope - went to HR today and showed them the 821D and also the screenshot of the approval of the 765 and they told me they need the physical EAD in order to let me back to work.

So this Wednesday I will reach 105 days...I'm going to call USCIS if I don't hear anything till then, what should I do at that point. Would I ask to talk to a tier 2 person? Should I file my application with NILC at to elevate my application?

According to NILC, here are 8 steps to take if your DACA renewal is delayed.

1. Check your case status at USCIS

2. Contact USCIS

Note: Only do the following if your case has been processing beyond 105 days from the date on your receipt.

3. Contact your local USCIS office and schedule an Infopass appointment to see an immigration officer. Note...The officer can give two month extensions if your case is within the 150 to 120 day window.

4. Contact the USCIS Ombudsman for assistance and dictate the steps you have taken. Ask for expideted handling via the online form. https://cisomb.dhs.gov/oca/form7001.aspx

5. Submit an outside normal processing time inquiry

6. Contact the Service Center handling your renewal

7. Contact your congressional representative and ask for an immigration case worker

8. Contact NILC or ILRC for assistance if your case is beyond 120 days processing time

Well another little analysis of the 200 receipt numbers 'ahead' of mine.

43 I821D/i765 all dated around 3/24/16.

Last I checked on 9/9 There were 17 approved and 26 still pending.

Now on 9/19 there are 19 approved and 24 still pending.

I'm happy for those two guys, at least.

Ask if they can pay you retroactively. You are technically allowed to work from the moment USCIS approves your application.
