No fees have been paid yet but my lawyer is going to contact NVC and hope to hear back so we can start gathering documents to send the i601a.

Is it possible to postpone the interview? Don't really want to go to China in the next few months....

Yes, you you just let your appointment pass and reschedule from what I’ve been told. They scheduled my husband’s even though he doesn’t even have his waiver approval yet.

I am sure you can. Try calling/emailing the NVC and see what they tell you.

Don't let the appointment pass without letting them know. Worst case scenario, they could think you have abandoned your application.

Definitely contact NVC, I believe the only bad thing about rescheduling is that you have to do the wait for a date all over again, one year for appointments at Juarez, but it may not be a long wait for you since you are going to China and they have different times.

You have to contact the consulate or embassy you’re having the interview at; not the NVC. When my husband received his appointment, I contacted the NVC and they told me I had to contact the embassy.

My understanding is that at least for AOS appointments in the U.S it is not advisable to cancel appointments. They say that it opens the potential for a lot of mishaps leading to delays etc...

Your with your situation though, it might be worth skipping the trip to China for now. I would think once flu season ends things should calm a bit.

At least until next winter.

Hopefully this virus die down in a few months. Worst case scenario would be getting stuck in China because virus get so bad and U.S close its embassy.

Hello Everyone,

I'm currently beginning the process of undergoing the employment sponsor route. We are currently waiting on a prevailing wage determination in order to file for the PERM. I just had one quick question; I am fully aware of what each step in this whole process will be but I do need confirmation that I will not be needing a 601A Waiver. I have both a legal entry (visa overstay) and 0 days accumulated of unlawful presence (first DACA approved 3 months before turning 18 and have had it ever since without gaps.) From my understanding these means I could undergo the consular process via employment (I-140) without being subject to the 3 or 10 YR bars, and thus I would not need to file for the 601A waiver. Can someone please let me know if I'm correct in my thinking. Thank you!

You cannot apply for I-601A if you dont have any unlawful presence.
