Wow thats interesting. so you had to leave the country and cross the border again? i thought border crossing was really risky...

Yeah lol not by choice of course I was just a kid. It was sort of a vacation I guess my parents wanted to see their parents. That’s the last time I’ve been there though. I’m 25 now and it’s a lot more risk from what I hear to be crossing like that.

I have a approved i-130 but I can't file in my AOS because of my visa overstay.
I'm going to see a lawyer next week to start my i-601a process but I'm concerned since this administration is all about ending chain migrations and what not.
Do you guys think it's still worth it to go through with i601a process and try to AOS once it's approved?

If you are a visa overstay, you don't need to go through the I-601A process. Your process will be much easier, quicker and no need to leave the country. Check out the "DACA to AOS" thread.

Hmm? I was told I need to go to my country of origin to do an interview. Wouldn't that trigger 10 year ban for me?

Do not go through the i-601a process, if your last entry to the US was legal. You can file forAOS.

Definitely, check with a lawyer to be sure.

Sorry to trouble you, but could you link me to a doc or an article that can explain the reason? I can't seem to find anything regarding this info other than what I already know.

If you entered with a visa, even if it expired. You can still file for AOS.

The 601A form is for those of us who entered the country without inspection (EWI).

Check out:
http://www.visalaw.com/abcs-of-immig...sional-waiver/

"If you entered the United States on a visa and overstayed (even if the visa was fake, or was in someone else’s name), you may be able to adjust status within the United States, without a waiver and without an appointment at the consulate abroad. You should consult an attorney before filing an I-601A waiver and before departing the United States."
