It's a tough call.

From the whole working illegally and affecting AOS later perspective, I honestly don't think it matters if you have already been guilty of working illegally pre-DACA. From what I understand, that doesn't bar you from being able to AOS through a family petition such as marriage. And if we are all so lucky to see immigration reform passed sometime soon, I'm sure they will be conscientious of that fact that many of us have had to work illegally and will not use that as a restriction measure. And I highly doubt you will run the risk of getting deported if you work past your expiration date, as some other poster earlier was claiming. That takes a lot of resources and government agencies don't exactly employ them if not absolutely necessary — right USCIS?

Now, from the perspective regarding your employer, it's a much trickier situation. If you work past your expiration and they realize that when you go submit your new EAD, that might cast an unfavorable light upon you. You could play dumb and act like you didn't realize there was a lapse in your permit. If your conscience won't let you sleep about keeping EAD secrets from your employer, you can roll the dice and let them know it's going to expire and see what they decide to do.

Ultimately, I think it just depends on your need. Can you go an extended period without income? How grave of an effect will losing your job have? Of course losing a job has a negative effect on all of us, but not equally. Some have dependents, some have mortgages and extensive bills, for others the job market is not good, etc. If the security of maintaining your job surpasses the importance of being honest with your employer, then the choice would be to continue working.

I know we do almost have identical timelines
Work permit expires on election day 11/8 hopefully i will have the card by then. I also requested AP on 8/1 for an event already passed so i'm not even sure how they're going to handle that.
Good luck with your case though hopefully you hear from them soon

At the end of the day, it is up to you as none of us here are qualified immigration attorneys to tell you what you should do. What I said is what my attorney told me, not something I got off online in another forum. But really it is up to you.

IMHO, I don't think you should continue working illegally if you can afford not too. Think of it in the long term. I know someone said that you can always says that USCIS was the one that dropped the ball as to why you continued to work with an expired EAD, but sadly I do not think that argument will hold much in the grand scheme of things as it if really just an excuse, I mean just look at how much of a priority we are to them? And like someone said, let's not give them any more ammunition against us.


Good luck with whatever option you end up choosing though

I think the above is pretty balanced advice.

Looks like we need to relax a bit bit people. I do have a some good news. I checked my status and says my card is in production as of Oct 13th. My renewal still hasnt changed or anything about appoved but at least the card is being produced. Mine expired Nov 1st I hope its gets here asap. Good luck ALL

My EAD has been renewed! Just 5 days before it was set to expire! Thanks God!

My official timeline is as follows:

821D/EAD renewal app received - July 13, 2016.
Biometrics done - August 3rd, 2016
Approved (Saw "Card being produced" update) - October 13th, 2016

Current EAD is set to expire on October 18th, 2016.

That guy who posted a message on here saying he just knows the EAD gets renewed about 2 and a half months after biometrics is a straight up legend!!

Would you mind saying where was your case processed please? I've been waiting since Late May. Mine is at the Nebraska service center
