Senate and WH sources state that the president will agree to open the government with the 3 week CR to allow for border negotiations. He will use national emergency as a stopgap if negotiations fall

Bad, because at that point negotiations stop and all this gets tied up to the courts. More waiting for dreamers and at that point supreme court can become an issue if there's any injunction or ruling.
