The challenge to DACA by the 9 states is that it violates the APA. The new regulation follows the APA which makes their case moot. The document describes the current legal challenge to DACA on page 16.

So, yes the courts may terminate the original DACA memorandum because of a procedural mistep but DACA will continue under the new regulation.

The ruling and the timing of the finalization of the regulation will probably be coordinated. Even if they’re not and the ruling cones before the regulation, there’s no way in Biden’s administration that ICE will come after DACA recipients.

TLDR: DACA forever
It's not really up to Biden in some ways. The GQP has weaponized the courts so they can use them to reverse DACA, put a moratorium on the new memo w/the latest procedural misstep they pull out of their ass, and "force" ICE to start enforcement. I say "force" because ICE are thugs that will be more than happy to oblige.

Anybody read the 81 pages and can do a TLDR; version? I was reading till page 4 and ran across the requirements again. I'm not going to lie, I was hoping that maybe they slipped in something in there to remove the age limit, but nope...I still miss the cut-off by because I was born 6 years too early. I did however notice the bit I didn't notice in the original DACA requirements. What do they mean that by the part in bold about the age requirements, unless they have been in removal proceedings or have a final order? Does that mean that those people don't qualify for DACA or does it mean those who don't meet the requirements get a free pass and do qualify regardless of birthday?

• Deferred Action. The proposed rule
would provide a definition of deferred
action as a temporary forbearance from
removal that does not confer any right
or entitlement to remain in or re-enter
the United States, and that does not
prevent DHS from initiating any
criminal or other enforcement action
against the DACA recipient at any time.
• Threshold Criteria. The proposed
rule would include the following
longstanding threshold criteria: That the
requestor must have (1) come to the
United States under the age of 16; (2)
continuously resided in the United
States from June 15, 2007, to the time
of filing of the request; (3) been
physically present in the United States
on both June 15, 2012, and at the time
of filing of the DACA request; (4) not
been in a lawful immigration status on
June 15, 2012, as well as at the time of
request; (5) graduated or obtained a
certificate of completion from high
school, obtained a GED certificate,
currently be enrolled in school, or be an
honorably discharged veteran of the
Coast Guard or Armed Forces of the
United States; (6) not been convicted of
a felony, a misdemeanor described in
the rule, or three or more other
misdemeanors not occurring on the
same date and not arising out of the
same act, omission, or scheme of
misconduct, or otherwise pose a threat
to national security or public safety; and
(7) been born on or after June 16, 1981,
and be at least 15 years of age at the time
of filing, unless the requestor is in
removal proceedings, or has a final
order of removal or a voluntary
departure order
. The proposed rule also
would state that deferred action under
DACA may be granted only if USCIS
determines in its sole discretion that the
requestor meets the threshold criteria
and otherwise merits a favorable
exercise of discretion.

Have family petition that is now officially current but with past skeletons, is risky to move forward with AOS. Life is on hold for now until laws and/or government becomes more friendly. Life kind of sucks at the moment but like Al Bundy and the mighty cockroach, I survive.

Yeah...all that "They're all the same" bullshit and sitting at home and not voting, or voting for Jill Stein really fucked over the country for the next 30 years. All for what? Hillary wasn't socialist enough to their liking? She wasn't "Likable"? A lot of Republicans didn't like Trump but held their nose and voted for him specifically because of the supreme court.

Hmmm...that wording is strange...it does almost sound like the age requirement doesn't count in that instant, but I haven't read anything about that anywhere else
