The challenge to DACA by the 9 states is that it violates the APA. The new regulation follows the APA which makes their case moot. The document describes the current legal challenge to DACA on page 16.

So, yes the courts may terminate the original DACA memorandum because of a procedural mistep but DACA will continue under the new regulation.

The ruling and the timing of the finalization of the regulation will probably be coordinated. Even if they’re not and the ruling cones before the regulation, there’s no way in Biden’s administration that ICE will come after DACA recipients.

The GQP has weaponized the courts so they can use them to reverse DACA, put a moratorium on the new memo w/the latest procedural misstep they pull out of their ass, and "force" ICE to start enforcement.
