“In the grand tradition of our country, we don't punish those who themselves don’t have fault,” she told reporters on a conference call. “What doesn't make sense is to use our resources to prosecute young people who have no criminal record, were brought here for no fault of their own and have no individual culpability. It makes sense to allow those people to adjust their immigration status in a way that's firm but fair.”

Napolitano said the Dream Act was not a substitute for comprehensive immigration legislation, but that passing it was the one thing Congress could do to help enforce immigration law in a sensible way.

"I urge Congress to set aside old labels that don't mean anything and get to the real substance of what this statutory revision would do," she said. "The law itself needs to be reexamined to see that it meets our country’s liberties and work force needs. ... That's where immigration reform comes in."
