DHS is Preparing for 50-state Mandatory E-Verify Law

While Republican leaders of the House continue to block a vote on a national mandatory E-Verify bill, the Obama Administration has issued a statement that it is getting E-Verify ready to handle a big expansion. U.S. Citizenship and Immigration Services (USCIS) is planning to launch a 2012 Web User Survey that will be used:


"In anticipation of the enactment of mandatory state and/or national eligibility verification programs for all or a substantial number of employers."


U.S. Citizenship and Immigration Services (USCIS) is planning to launch a 2012 Web User Survey that will seek input from approximately 2,800 employers nationwide to obtain information about the E-Verify program, Government Security News reported.

USCIS published a Federal Register notice yesterday asking the Office of Management and Budget (OMB) for permission to establish the survey initiative.

NumbersUSA Founder Roy Beck thinks DHS and USCIS are moving in the right direction.

"I laud the managers and workers at DHS to rise above the politicians and to do the practical work as necessary," Beck said.

The agency issued an earlier notice in the Federal Register on January 18, but received no comments from members of the public. It has now posted a second notice and invites comments by May 3.

The thing is there will only be comments from the Employers if the law goes into affect or even lawsuits.The Administration certainly is trying to implement quite a bit of enforcement programs as we speak State by State.Last I checked,DHS would like to implement Secure Communities,E-verify & Real ID in full by next year.Secure communities has just been activated in Washington State & Montana.

It should be interesting how this all turns out considering most lawsuits were from more liberal leaning groups and now that there is a Democrat as President it should be interesting how this is pursued in the courts[if it is].

Not necessarily. President Bush made e-Verify mandatory with Executive Order 12989 for employers who take on federal contracts. He didn't have to go through any congressional approval.

The President can also use executive orders to enact deferred action for undocumented immigrants, update the immigrant registry date (from 1971 to 1996) and allow TPS for dreamers. It's perfectly legal.

It's funny how NumberUSA is now welcoming executive orders. They would cry out treason if Obama said anything about executive orders for our benefit.

So any Overstay or EWI automatically gets a GC if they came here before 1971?

yes. If you someone can show continuous presence since January 1, 1971, he/she can apply for a green card right away, regardless of EWI or Overstay.

One of the recommendations on Roxana Bacon's memo was to advance the registry date to January 1, 1996. Historically, the registry date had been updated in every 30 years or so to a more recent date. Another update of the registry date is way overdue. If it's advanced to 1996, many of us will benefit from that.

If you came here before that 1986 law then you would qualify also.
