I need to submit an FOIA request to CBP for I-94 records.

Hello everyone,

I need to submit an FOIA request to CBP and i was looking for some guidance from anyone who has experience going through this. This is just for my I-94 records, specifically ones that date as far back as 15 years or so.

How does this whole thing work?

Any help would be greatly appreciated.

There's 2 things you can do.

Either you submit a FOIA request with CBP, or you file I-102.

FOIA requests are generally very cheap, you pay for printing if there's a lot of pages and the actual manpower to do it, and nothing else. Generally under 20 bucks.
You can use this link to submit the FOIA request online. You need to submit a notarized statement which says that you affirm that you are who you say you are.

Another option is to file I-102 with USCIS. It costs $330 dollars.

However, it says to submit a written notarized consent document only if you're requesting documents for someone else. In this case i'm requesting them for myself, so i'm a bit confused as to your suggestion.

Can you please elaborate?

If you are requesting them for someone else then you need a notarized consent document.

If you are requesting them for yourself then you still need a notarized document, where you basically affirm that you are yourself and want your own documents. It's a little strange, I know.

Click on the 3rd link I provided, scroll down to Appendix B, it has a sample of the document I'm talking about, however that one also includes parts about letting someone else access them.
Sample without that parts, where you want your own documents, would be something like this:

Affirmation of Identity {centered, bold}

This is to affirm that
I, [Name here] request access to records maintained by U.S. Customs and Border Protection which pertain to me.

My present address is:
[address here]

My date of birth is: [DOB here]
My place of birth was: [city, country of birth here]

I understand that knowingly or willfully seeking or obtaining access to records about another person under false pretenses is punishable by a fine of up to $5,000. I also understand that any applicable fees must be paid by me.

I request that any located and disclosable records to be forwarded to me, at my present address listed above.

I hereby certify under the penalty of perjury that the foregoing is true and correct.

Executed on ___________________ {date, don't put it in until you're at the notary}.

_______________________________________________ {sign here once the notary instructs you to do so}
(Signature of Affirmant)


[ ] - Wildcard, put whatever applicable info there, e.g. [Date of Birth here] becomes, for example, March 2nd, 1988.
{ } - Comments, this is just to clarify a field, leave this out of the actual document

Demise info is on point! I filed one last year to get my old I-94 from when I enter the us in 89, I think I received it after 2 months.

Alright, i submitted a request yesterday and used a notarized affirmation/declaration form.

I'm supposed to get e-mail notifications and can check on the status of my request in their website, so i guess now we play the waiting game!
