Looks like nobody wants the job. I'll do it in exchange for sovereignty and a deed of land to any nation in Africa. Thus installing me as grand emperor of DogManland. I'll make the natives perform elaborate plays from their culture. We will be capitalism only. All rights given unto them by their gods will be respected in our constitution.

I too got a bad feeling about this. From what I’ve been reading, looks like their going to try and appoint him in an acting capacity so he can go straight to the job without senate confirmation

Under Vacancies Act it's only possible if you've already been appointed to a different post and confirmed by the senate and only up to 180 days.

For instance if Barr were to resign as AG someone like the Director of ICE could be temporarily appointed as Acting AG but that's because it's a position requiring senate approval. This guy doesn't hold any position in US Government.

There are of course Recess Appointments under Article II, Section 3, Clause 2, but congress in general holds pro-forma sessions making these impossible.
