Even if he refile.. it will get sued again right? What happens if biden win the presidency. Can he stop that case and let DACA go on?

It would be pretty dumb to do anything with the election only a few months away. You never know with Trump. He could be just playing up to his base. They’re saying his rally today was smaller than expected.

That is exactly what is happening. Don’t expect any further action on DACA (both by Congress or the admin). It’s election season, can’t afford any risk. They both need the Dreamers to win.
