about driver's license...

Driver License Rules & Regulations
Ohio Administrative Code Section 4501:1-1-19, 21, 22

In order to obtain any Ohio Temporary Instruction Permit Card (TIPIC), Driver License, Commercial Driver License, State of Ohio Identification (ID) card, Motorcycle, Moped license, the customer must present documents to prove all of the following five elements: (1) Legal first name, middle name, OR middle initial, and current last name; (2) Date of birth; (3) Social Security Number (SSN), if ever assigned; (4) U.S. citizenship OR U.S. legal presence and (5) Resident street address in Ohio.

here's the requirement for applying for driver's license in Ohio. will deferred action be sufficient enought to prove U.S. legal presence?? they also required me have at least two acceptable proof of identification documents, one of which contains my soon to possess Social Security number. and the only other forms of ID that i have are my valid passport and my expired visa.

Hold on I gotta put on my glasses cause I can't read this haha

But in all seriousness, I was wondering that as well. North Carolina uses "legal presence" and I wasn't sure if that is limited to permanent residency

Re: about driver's license...

According to the information on the uscis website, Dreamers with approved Deferred Action based on the June 15th 2012 rules will no longer accrue unlawful presence. We are not being forgiven for previous overstay or unlawful presence, but we will no longer have an unlawful presence in this country. Sounds like enough information to obtain a Driver's licence that requires "legal presence."

Re: about driver's license...

A lot of states require "legal presence". I understand its way to early to be thinking about this, but will it be a problem?

An employment authorization card, etc, maybe let you squeeze by..

ie: http://www.txdps.state.tx.us/DriverL...tatusChart.pdf

...
* Applicant with Employment Authorization Document (EAD) with all other categories
...
* Persons granted deferred enforcement departure (DED)
...
* Persons granted a stay of deportation
...
etcetc

Re: about driver's license...

I think an EAD should be enough to satisfy the 'legal presence' definition since they say;

"United States Citizenship and Immigration Service (Uscis) Documents - Must be an original and valid, or like documents issued by the successor agency to the USCIS. "

Re: about driver's license...

Every DMV website should have a "list A" document that you must provide. Im pretty sure every single DMV (maybe except a few) has an EAD, work authorization document listed to fulfill that requirement.

Re: about driver's license...

California allows you to have a DL just by showing an EAD.

I know that my dad's friend got a driver's license and a SSN from a work permit that he was granted a while ago. No worries, man. My only concern is whether or not i'll be qualifying for the work permit myself (since i'm still in high school, almost done btw).

Trust me, my sister did it with no problem at all.

The expiration on the DL will match the expiration on the EAD. But you can renew as long as you have a valid EAD.

Birth date verification and legal presence requirements

The issue of identification reliability, integrity, and confidentiality is of prime concern to all citizens. Eligibility for government services, issuance of various licenses, assessment of taxes, the right to vote, etc., are all determined through evaluations based on identification documents. It is critical that identification documents be authenticated and accurate in identifying each individual. The California driver license and ID card have been declared as primary identification documents in this state by the California legislature.

State law requires every applicant for an original California identification (ID) card and driver license to show verification of birth date and proof of legal presence within the United States to help safeguard the accuracy and integrity of departmental documents.

If your current name no longer matches the name on your birth date/legal presence document, see "True Full Name" and "How to Change Your Name" for more information.

Only the original or a certified copy of one of the following documents is acceptable:

US Birth Certificate (certified copy from state or local vital statistics office)
US Certificate of Birth Abroad or Report of Birth Abroad
Federal Proof of Indian Blood Degree
USCIS American Indian Card
Birth Certificate or passport issued from a US Territory
US Passport or US Passport Card
US Military Identification Cards (Active or reserve duty, dependent of a military member, retired member, discharged from service, medical/religious personnel)
Common Access Card (only if designated as Active military or Active Reserve or Active Selected Reserve)
Certificate of Naturalization or Citizenship
Northern Mariana Card
USCIS US Citizen ID Card
Permanent Resident Card
Temporary Resident Identification Card
Canadian Passport/Birth Certificate
Non–resident Alien Canadian Border Crossing Card
Valid foreign passport with a valid Record of Arrival/Departure (form I–94)
"Processed for I–551" stamped in a valid foreign passport
Permanent Resident Re–entry Permit
Refugee travel document
Certified court order or judgment issued from a court of competent jurisdiction. Must contain name, birth date, place of birth, legal presence status, and judge’s signature.
Certification from California Department of Corrections or California Youth Authority
Employment Authorization Card
Valid I–94 stamped "Refugee," "Parole or Parolee," "Asylee," or Section 207, Section 208, Section 209, Section 212d(2), HP or PIP
Valid I–94 with attached photo stamped "Processed for I–551 temporary evidence of lawful admission for permanent residence"
Notice of Action (I–797 Approved Petition) – must indicate approved extension of stay or change in status that grants temporary or permanent residency, or indicates that an original, duplicate or renewal Resident Alien card is forthcoming.
Immigration judge’s order granting asylum
Mexican Border Crossing Card with valid I–94
U.S. Border Crossing Identification card with valid I–94

Thanks a lot, appreicate it.

i have never owned or driven a car, but i have searched around lately and a lot of people recommend buying an older car and if you have someone available ( i don't have that luck) so that they can put your insurance under them so it can be around $100 or even less a month.
