Ohio Administrative Code Section 4501:1-1-19, 21, 22

In order to obtain any Ohio Temporary Instruction Permit Card (TIPIC), Driver License, Commercial Driver License, State of Ohio Identification (ID) card, Motorcycle, Moped license, the customer must present documents to prove all of the following five elements: (1) Legal first name, middle name, OR middle initial, and current last name; (2) Date of birth; (3) Social Security Number (SSN), if ever assigned; (4) U.S. citizenship OR U.S. legal presence and (5) Resident street address in Ohio.

here's the requirement for applying for driver's license in Ohio. will deferred action be sufficient enought to prove U.S. legal presence?? they also required me have at least two acceptable proof of identification documents, one of which contains my soon to possess Social Security number. and the only other forms of ID that i have are my valid passport and my expired visa.

But in all seriousness, I was wondering that as well. North Carolina uses "legal presence" and I wasn't sure if that is limited to permanent residency

According to the information on the uscis website, Dreamers with approved Deferred Action based on the June 15th 2012 rules will no longer accrue unlawful presence. We are not being forgiven for previous overstay or unlawful presence, but we will no longer have an unlawful presence in this country. Sounds like enough information to obtain a Driver's licence that requires "legal presence."

A lot of states require "legal presence". I understand its way to early to be thinking about this, but will it be a problem?

An employment authorization card, etc, maybe let you squeeze by..

I think an EAD should be enough to satisfy the 'legal presence' definition since they say;

"United States Citizenship and Immigration Service (Uscis) Documents - Must be an original and valid, or like documents issued by the successor agency to the USCIS. "

Every DMV website should have a "list A" document that you must provide. Im pretty sure every single DMV (maybe except a few) has an EAD, work authorization document listed to fulfill that requirement.

California allows you to have a DL just by showing an EAD.

I know that my dad's friend got a driver's license and a SSN from a work permit that he was granted a while ago. No worries, man. My only concern is whether or not i'll be qualifying for the work permit myself (since i'm still in high school, almost done btw).
