DACA APPROVED LAST YEAR, married USC!!
 
I finally married my GF of 3 years! We have everything ready ive done all my
Medic exams, got all forma ready to go! We will mail them out on Friday! 5/10/13. I got approved for DACA last year! Only reason I am able to adjust while in the country is because I came with inspections with my Visitors visa back in 2000. I will be keeping all of you guys updated on how my case goes since most of you also are wondering the process of adjusting with husband/wife of a USC , if you came with inspection. Thanks guys! & pray that our case moves very fast! I am eager to start college next spring being that I can't with DACA in this amazing state that I live in!

Interesting, I wonder if anyone approved for DACA is able to adjust status with marriage to a USC but also EWI when they came.

No, EWI is not cleared by DACA. You could probably clear it if you were to get Advance Parole, then leave and re-enter on the parole, but there is always the risk of not being allowed back into US.

Right. Only way to adjust while in the country is by having been inspected!

There's always 245i, though few people are still covered by it since it ended in 2001.

Glad to hear success stories of people not having to leave the country to adjust status/marry USC. I wish I made it that far, my recent relationship ended because my gf did not want to deal with my status. I came here with visa at the age of 2 and never left. Also, recently got DACA approval. Please keep us informed on your process. Congrats on everything.

If DOMA gets knocked down I will get married to my partner of 3 years as well and get my green card that way. Crossing fingers for doma to be knocked down by the end of June because they will make the ruling they said by the end of June :)

yeah didnt obama modified so that whoever is trying to adjust status within the US, doesnt have to leave at all? a friend of mine just got his green card through his step dad, he is 21 (started process when he was 20) and he never had to leave because of this new law. He EWI btw.

I heard something similar from my mom who knows a lady who was EWI and got married a few months back and has her green card already. She told me to talk to a lawyer about it because my gf of 4 years and I want to get married but I'm waiting for my DACA to be approved so in case they deny our petition, it wouldn't affect me in a negative way.

yeah dude, i feel you. my girl has always known my situation ever since day one i came clean because i know alot of girls dont like to deal with shit like that. but we have been together close to 3 years and we got married last month! finally! and yeah im glad my parents brought me with a Visa, i couldnt imagine how it would be to have to leave the counrty to adjust. good luck to you in the near future tho :) you have it set having came legally like me bro!

Not as far as I'm aware. Only thing that comes into mind is a grant of parole in place, which makes the person considered paroled into US after already arriving illegally. As far as I'm aware it is restricted to family members of military only.

If you're talking about the I-601 waiver you can file it without the need to leave US, however once approved you still need to leave to undergo consular processing abroad. So you go on a 2 week vacation, pick up your immigrant visa, and go back home.

UPDATE! I mailed in my I-485, I-130, I-765. On may 14,2013 and I just got my fits notice of action today!!!:)))) my priority date is may 15,2013 . Should get my biometric appointment soon! So excited!

im asking because i too want to get married with my girlfriend but we are young and i dont think it will be possible, unless with a sponsor.

Very interested in this thread too. I've always heard different things about adjusting status through marriage with a USC, even when the person entered with inspection. Some have been positive, but a few lawyers have told me it's an unlikely / difficult process..

Same here!! Well except i don't have a partner :lol: but if i did, DOMA still stands in the way if I ever wanted to go this route.. Hopefully it will be knocked down by SCOTUS, or in immigration reform.. Hope you guys are able to adjust eventually

i am 20, and my wife is 18. & yes we used a financial sponsor because of course my wife cant financially support me. especially now that she is going to attend college in the fall. money wise its been hard because all the immigration paper work is very very expensive, all the medical process is also very expensive, but its well worth it, but dont rush into things just for immigration benefits!

as you guys know my priority date is may 15, 2013!
well as of 5/28/13 i received my bio appointment for 6/12. buttt of courseee i did a walk in on 5/30/13. jajaja soo now im just waiting on 1) interview date or 2) EAD (wich i dont care for becuase i already have one plus once i have my interview with my wifeee and they approve my case, i will get a GC issued immediatly wich will replace any EAD/AP)

This. I adjusted as EWI through 245i. I believe I had to a pay a fee of about $1000 for that but I didn't have to leave the country.

I think most people looking to or likely to benefit from 245i after this point are people from Mexico or maybe the Philippines where they have very high visa waiting times.
