Aos through Employment
I just have a question regarding AOS through a job I work for a trucking company and they are aware of my status and they want to sponsor me to get a GC know that I will accrue unlawful presence after I turn 18.
Got approved first Daca on 11/29/12 Turned 18 on 12/01/2012 My daca renewal was approved on 11/18/14 My second Daca renewal was approved on 9/16/16 I want to know if I'm still in luck Thinking about going to an immigration attorney to get more info but I would like to see your answers first |

I'll chip in my two cents. Adjustment of Status is impossible for you because you have no legal status. I remember you stating that you EWI and the only way to get an immigrant visa is through consular process.

We can't get sponsored unless we have a valid visa available or you are grandfathered under 245i.
I also would like to add: If you had daca before turning 18, you currently do not have any accrued unlawful status (for 3 and 10 year bans). Meaning, one could leave and comeback (if the correct visa was available) and get sponsored by your company. |

Employee sponsorship also places a burden on the employer to prove that you are the only person they could find to do the job. You should get a smart immigration lawyer to help you get around this potential roadblock.

Here is a question. My father just told me that one of the employers he does work for said they would like to adjust his status for him. I told him is not possible but he was saying they have done it with other Ecuadorian people.
So based on what I read here, if you crossed the border EWI you cannot adjust. Is my dad misinformed by his employers? My father is a visa overstay. |
