Constitution doesn't say that it needs to be a criminal offense. I don't see why a pardon wouldn't matter.



Dude... There's a very thick stripped line between being an optimist and being crazy.

So how long would be the ban if someone does not qualify under the registry?

Yeah, I see your point. The only thing then is that, just because someone doesn't have unlawful status, doesn't mean he or she does have lawful status. I'm leaning toward the notion that that person still doesn't qualify for adjustment under INA 245 or admissibility under INA 212 (since inadmissibility isn't punishment or a fine for an offense, merely a civil consequence).
