Hello fellow dreamies, I am new to the forum, but have been checking the site a few times a week over the last few months. I was hoping you guys could help me because i have a problem that I think might be serious. I have been attending a California CC since Fall 06, but the problem is that I "lied" in my application and claimed to be a citizen not knowing the possible consequences in doing so. I simply wasn't aware there were other options.

Would it be possible to change that now and adjust my status to AB540? Did I unknowingly screw myself over if DA passes? Can you or do you know someone who could help?

Any input good or bad would be greatly appreciated.

I was in a similar situation as you before. During my senior year of high school, I applied to a California CC and put "H1B dependent" as my status. At the time, my father still had a petition with the USCIS, but it still wasn't approved (it has since been rejected). They classified me as a nonresident (even though I graduated from a California high school), because they needed proof of my status. I obviously didn't, so they didn't let me change my status to AB540. This meant I had to pay really expensive out-of-state tuition, but I had no choice.

Are you planning on transferring to a UC or Cal State? My advice to you is this: when you apply, make sure you leave the citizenship portion blank or put "other" (I forgot what it is exactly). I go to Cal Poly Pomona and am now classified as AB540. Your citizenship isn't included in your transcript, so my new school doesn't have my wrong info anymore.

As of right now i'm not sure which of the two I will be applying to because my major has changed over the years and currently I am unsure of which one to pursue.(English and Nutrition or Food Service Management) I am seriously considering double majoring because I want to do something that is food related and I really enjoy literature as well. My main worry was being penalized for claiming to be citizen when/if DA passes.

Honestly, I would not worry about it. They have bigger fish to fry. If the dream act passes I think it would take into consideration the fact that some beneficiaries could not be completely honest at all times when living the lives they were tossed into…

If they didn't notice when your application was processed, then there's no reason for them to go into your file now and check your status. Just be sure to let them know you're an AB540 student when you transfer because it's unlikely that they'll overlook that detail again, and you could be charged out-of-state fees.

I really hate to say this but technically you do not qualify for DREAM or any other method of legalization. You should talk to your lawyer but claiming to be a citizen is a permanent ban if USCIS finds out and it's really sad in your case because you didn't do it to get any benefit. In California, you already get in-state tuition. Again, don't take my word for it but make sure you mention it when you go speak to a lawyer.

This goes to everyone else. NEVER CLAIM TO BE A CITIZEN ON ANY APPLICATION. If USCIS finds out, you will never be allowed to become legal.

^The consequences are a permanent bar to re-entry & a permanent bar on all immigration benefits.It is a federal felony claiming to be a U.S citizen,when you're not.

Well, I had met enough Dreamers to see that this is a common case. First of all, check with a lawyer. Second of all, I am going to check with mine and come back in a couple of days with a response.
