Hm... how about consulting a qualified immigration lawyer? We do not offer legal advice here.

I'm guessing your dad only has a work permit, plus you're 20 so the short answer is no, you're screwed. Sorry boo.

Since when are members not allowed to ask these sort of questions? People have been asking questions like this one for a while ( at least since I joined the forum), and aren't turned away.

I agree that the op should consult with a lawyer, as everyone should always do, but if someone here can point him in the right direction, I don't get what is wrong with that.

Good luck jesusfrkxpanda.

You never mentioned at what age you were adopted & how long you were with your adopted parents before filing any immigration paperwork?

Usually someone has to be with their adoptive parents for at least 2 years & adopted under the age of 16 prior to any immigration paperwork being filed through adoption.

Also unless your real father is a US citizen you cannot become legal through your real father.

with your situation you do have a couple options, if your dad has a green card, he can file for you now and it is better since you will not be older than 21, but you will have to wait for him to become a citizen before you can get a green card because of the green card backlog but you will be in the system because you will have to file an I-130 first then later I-145 for the greencard.

Another option is to marry a US citizen and you will receive your green card in less than a year and since you came here legally you might not have to go back first....

But if your mother was an F1, and if you were a minor then, check your passport and see if you have an F1 thing in there and it should say a "D" or something like that, meaning duration of status... So as long as you are or were in school then you might be legal... Im not a 100% sure though but you can call a lawyer or there is this link for a lawyer in NY he is really good... the website is http://www.4immigration.com/
you can call on his radio show and ask your question and it will be free. you can call 1800 LAW-LINK and you can ask them for the radio show number..

But you are doing a good think , just keep on always asking questions and looking for solutions.
