The US have some "interesting" immigration laws and by "interesting" I mean really stupid. Mostly it's all the conditionals one law might be divided.

Did you know that depending the type of visa you apply for it has an "intent". For example a tourist visa (B1/B2) is non-immigrant intent visa. A working visa (H1B) is an immigrant intent visa. Interesting, did you know a student visa (F1) is a non-immigrant intent visa? Surprised?!?! Yes? Well so was I when I tried to changed my status and fail and later couldn't go back to my F1 because of my intent had changed.

The real stupid part is that a student visa has a non-immigrant intent. Why does it? Where is the logic behind this classification? Do you really think that a person after obtaining a bachelor degree and participating in an internship for one year has an "intent" to return to their home country? The answer is obviously "no" at least for most college grads.

So, why do I keep saying this classification is stupid. Well, first many countries like Canada, Australia, New Zealand, etc. seek skilled professionals in certain fields. Why doesn't the US have a list of needed skill workers and offer recent graduates the opportunity to work in the US?

Well the US doesn't have a list maybe because the typical American youngster wants to be lets say an Electrical, Computer, Chemical, or even Civil Engineer, Doctors, Layers, etc. not. If I remember correctly I think when I graduated in 2004 we were probably no more than 10-12 Computer and Electrical Engineers. Which out of those 10-12 graduates we probably had 1-2 US citizens which 1 I'm sure was a Cuban decedent but was not very excited about working in the field and went back to serving tables at Red Lobster.

So, technical professionals isn't a growing pick among high school graduates at least not among the American crowd. Most parents don't even care their kids go to college. Typical American dad, "hey honey, talked to our son, guess what? He doesn't want to go to college! So now, we can finally take that cruise in the Caribbean we wanted and I can buy that 52" HD TV we always wanted in the living room!" American mom says "That's great honey!!! When is he getting a job and moving out?".

You might laugh but this is a typical scenario in the US. So you start to see why I think the current Immigration laws might have some flaws to be consider stupid.

Currently, the US lets college graduates of skilled workers needed for the production of the country's needs return to their home countries. But did you know a lot of Central American countries have treaties and agreements to let them immigrate to the US. For example Cuba and Nicaragua they had a huge exodus to the US. Many don't even have 6th grade or speak English. The 1st Cuban exodus The Mariel boatlift were mostly convicts and mentally ill released by Fidel Castro. But here they are working hard at obtaining the highest benefits from Medicare/Medicaid, food stamps, housing, etc.

Please don't let my inner bitterness offend any Cuban or Nicaragua citizens. As a matter of fact one of my closest friend is Cuban and my neighbor. The comparison is just to elaborate on how imbalance current immigration is dictated.

Today, I think what does the typical American youngster wants to do when he graduates from high school? The other day I was reading about how Americans would claim that illegals take their jobs. Of curse this wasn't in the agricultural area (http://www.takeourjobs.org/) the site claim 50% are illegal. And on the technical side this article claims it isn't there either (http://www.wired.com/dangerroom/2010...security-risk/).

So, where is immigration leading the USA? We don't know, even the government isn't sure. I would say some well thought out plan most be approved soon. The DREAM Act is going places but it should included college grads. After all it involves the final goal retaining illegals with college degrees for the country's workforce development.

Oh my sob story, I'm a Computer Engineer graduated from an accredited US university in 2004. One year of industry experience with a top 100 fortune company at the time. My working 76 year old mother is a US citizen. My priority date is August 2005 and I can't adjust my status because I been illegal for 6 years.

I apologized if any of my comments might have offended any one. It wasn't my "intent". Unfortunately, it isn't easy to be illegal some days like today I'm bitter and irate some days I'm sad and depressed.

i feel like your being little unfair. because you do have a degree and xperience with a top 100 fortune company, doesn't make you better or worse then a person who didn't finish 6th grade or speak English. I'm glad you had a chance and ambition to achieve something important in your life. i know hoe your feeling well we all know because we are in the same situation. some of as are just high school graduates some of us cant even go to collage or university, we don't have student visas, many of us wishes to have one. i am a graphic designer, attending community collage because i cant be accepted anywhere else. but is that make me less then you? do you as a "smarter" person with better degree deserve different lows, different treatment then me or that person who came here for better future maybe not even for themselves but maybe for their family for their kids, how about a person who didnt finish that 6th grade but maybe his or her kids will one day became Computer Engineer and be better then you. and you are judging americans why? dont you see that this is the problem, everybody is judging everybody! everybody thinks they are better then someone else! why?
you bring up american kids, so what they dont go to collage so what the parents travel? why that makes them less? thats their life if that how they want to live let it be! but know that it dosent mean you are better then them!
instead hating others concentrate on yourself, be patient. good things happen to good people.
maybe there is a reason why me and you and others dont got that chance of being equal, maybe before we do get it we need to learn what is really important in life. maybe we need to improve something in ourselves.
this website give us opportunity to connect with other people in our situation. we become a community we support same dreams, that is something positive hating on others just because we feel that their less then us wont help no one! remember!
i know you said things out of frustration but im frustrated with many things as well and one of those things is how we treat each other. that is something everyone should think about!

Unfair, yes life is unfair. Frustrated, yes very frustrated at times. Envy, yes I probably was when I wrote the post. Envy of all the immigration and non-immigration benefits that are awarded to those that done little to nothing to earn and keep them but they are still given because of an unfair, unbalanced, outdated immigration laws or government policies.

I don't think I'm better than anyone that wasn't the message. I think the US immigration system is unfair. I think it is unfair that you have to go to community college instead of university of your preference or that you can't continue your studies after graduation. I think it is unfair that people have to travel to Washington State to get their Driver License. And the list can go on and on of so many things that are unfair to what affect us.

I agree the DAP forums opens and enlightens people of the many actions and opportunities available.
