My girlfriend is 16 1/2 years old. By the time the DA is voted on again, she'll be 18 1/2 and would be banned for 10 years if deported. She is an A/B student and she should not let her education go to waste. Would It bea good idea for her to go back to Argentina and apply normally? What are her other solutions? How would she even go back?

do not advise her to go back or to stay. she should be the one deciding. shes old enough now. just explain the consequence and upcoming situation. give her facts and let her decide.

If she has some way of getting back here like via relative petition, then yes she should go back.

Otherwise, she should stay.

DA is not dead, there is still 2012.

My opnion is.. this is a problem of how sure do you know what you are doing... Unless she has any preference this option over other option..(high chance that she will regret later) unless she is sure that she can come back through getting the right visa and all... (she should talk to her parents about those)... you know what to tell her.

making a decision like this at her age is different from making a decision at our age or my age..

She can go back now and try to come back with a student visa or immigration visa(?)
OR
She can go to college and then go back to Argentina to further pursue her education or get a job..

And a third option;; since she is your "girlfriend" who is only 16 yrs old.. what if she finds someone and fall in love with him all the way to getting married?

She really should decide on her own.. Who knows what is going to happen in the future?

She knows the facts, she just doesn't care anymore. She told me that she has given up on her life and she has no future. I want to get her on the right track. The only legal relatives she has here are her 4 year-old brother and her 10 year-old sister.

nevermind about me saying that she's old enough decide. she's 16.5 and doesn't care anymore? about what? its ony been 6 months since she turned legal age even to work. what hardships did she face so far for her to even say such things? maybe she should go back and face the reality in argentina. i'm not being mean. thats what i think.

I'm seventeen. I don't plan on getting married for a long time. If her and I don't work out, then she could be screwed for several years.

If she goes to Argentina, goes to school there while applying for whatever she needs here, I feel that would be the least-risky way for her to succeed.

I wish I was 16 and could buy some time lol

If I were her I would finish high school and right before turning 18 I would leave so that I wouldnt get the ban.

Then you would go with her get married and bring her back. It sounds easy but its complicated but not so much since she would already be in Argentina and would have no illegal presence in the US.

Well, her life has basically been a huge mess. She's been homeless for a few years of her life. Her parents abused her, AND she's graduating high school in 2012 for nothing. She can't afford college, so what's she gonna do? She can't do anything.

I think it would be best for her to go back for a few years to attend free college there while she waits to come here the legal way.

She turns 18 in May 2012 and graduates that June, so that's a problem.

Also, nobody answered this question: How would she even go back? Turning herself in?
