Me and my family moved from The Netherlands and came to the United States back in 97 on a E-2 workers visa after we lost our dairy business we could not renew our visas. We had no choice but to the stay here there is no life back in our home country. The question i have is i married back in September 2010 to a girl i loved deeply didn't marry just to get legal here. After 7 months she confessed of having an affair the last 5 months. She left in April 2011. Right before she left we were getting ready to contact immigration and getting started on the whole process of getting a green card. We are still married to this day haven't gotten divorced yet. Can i still apply for a green card??
I am very desperate my life is on a hold i want to go to school and live life to the fullest.

I am not 100% sure of the answer to your question but a better site to post this question is http://www.immigrate2us.net/. There are a lot of really knowledgeable people that have more experience in this area. This would be a good place to get started and then of course consult a lawyer.

The problem is *you* can't apply for a green card, it has to be through your spouse. Though you are technically married, from what you've written the relationship is over. Even if she agreed to submit the application, it would not be a smart move (and against the law, even though you initially married for love) to submit an application since you aren't really together. How will you prove you married for love if you aren't living together, have shared bank accounts, etc? Immigrate2us.com is a good resource, but I believe you will get similar advice there.

Thanks for the advice. I wasn't really sure if i should get her to apply for me since the relationship is over and we don't live together no more. I have submitted an application for the green card lottery every year for the last 10 years and no luck at all. My sister is 13 and born in the US when she turns 21 we can get citizenship through her. But that's too long of a wait.

The Netherlands is a beautiful country but i moved here when i was 11 so i don't really know a whole lot about the country and forgot a lot of the language and hard to write in dutch too.

Man, I get what you're saying... I'm in the same exact situation.... I came here when I was 11 from South Korea with my family with E2. They do same sh*t to most of E2 holders... They denied our visa renewal after 6 years without even giving us time to adjust our status. The big problem for us is that our business is doing slow, but we can't close it cuz of rent contract, can't bankrupt, and it's hard to sell....

Given the fact that he is 25/26 now and doesn't know much Dutch. It would be hard. What is your educational level? Do you speak another language, like Spanish, German, French? Netherlands has different educational system, don't they have a lot of vocational schools? If they offer free college, returning will do no harms.

Also as a Dutch Citizen you can work/live anywhere in the EU.
