All others who are NOT a citizen, national, lawful permanent resident, refugee, or asylee must present:
Valid documentation issued by the U.S. Dept. of Justice, U.S. Dept. of State, U.S. Dept. of Homeland Security, or U.S. Citizenship and Immigration Services, that shows LAWFUL TEMPORARY ADMISSION to the U.S. A list of acceptable documents can be found in the Temporary Visitor Issuance Guide (PDF).

Temporary Visitor Issuance Guide: http://www.txdps.state.tx.us/DriverL...tatusChart.pdf

" Person granted deferred action status
Can apply for license? YES
♦ Immigration documentation indicating this status.
1 year unless federal immigration documentation indicates a defined lawful presence expiration date which is less than 1 year.
"

So perry can say whatever, but I will take this motherfreaking paper to the DPS office, if they deny, I will sue their ass.

I give this to people who are currently in removal proceedings I sent them with proof of this which is the notice to appear if you notice page 8 says they do qualify to get the DL but in my years working there we have yet to see someone get this. I hope they don't try to pull that when def action people go.

it's also weird because if you look at the list of documents that can be used to prove your identity (http://www.txdps.state.tx.us/DriverL...quirements.htm), you can use your passport with expired visa as a primary document. So it seems as though Texas has never cared that much.

I'm really hoping Perry was just BSing us. Having to deal with this would really suck. But I'd probably move to another state if I couldn't get a DL.

Here's an article from the Houston chronicle. very weird, they have a COMPLETELY different interpretation than what txgirl thought. this one's very promising:

^^^you still have to prove that you have lawful presence. expired visa is only acceptable to prove identity.
