Sorry for creating a new thread. There is a thread already on this but I'm not sure of the OP there had his approval notice expiring in a year as well. I need some concrete advice please. My approval notice clearly states my case has been deferred under DACA for two years. However, the approval notice has an expiry for one year. This triggers my EAD's expiry to be Nov 2013 as well. Do I just call the USCIS hotline from the case status website or do I schedule an info pass? Also, you think I can go ahead and apply for a social security number meanwhile? Thanks.

That link is to a thread about typos on the EAD which is not concerning your original question.

Someone else had the same issue and called USCIS to determine why his EAD expired in 1 year. I believe the answer he was received was "prosecutorial discretion."

What do you mean by that? Please elaborate. Are you saying they're using judgment and found something within my case to make that decision. I honestly don't mind because I know for sure it will be renewed. I just don't want any complications in my SS/DL application process. I'm planning on switching my off the book jobs straight under my SS and start getting them reported under the number. I actually want to pay taxes now.

Also, We're awaiting my sisters EAD this coming week. If indeed it is due to prosecutorial discretion, then hers should be for a year as well. But if hers is going to be for two years as I suspect, I'm going to give them a call. Gonna consult the immigration paralegal at work about this. Everything else in the EAD is perfect.

Link to thread is below.
Quote:
I821D is valid for 2 years. Which basically states I'm under deferred action until 2014

I765 is valid for 1 year. My EAD is valid for 1 year. This is due to "prosecution discretion" as the customer service rep said.
Quote is on page 6.

USCIS at their discretion decided to issue you a 1 year EAD. Could it be a mistake? Absolutely and I recommend you call. However, if it is "prosecutorial discretion" then there is nothing you can do because that decision was made at their discretion and are not required to explain why.

And you won't have any complications with your SSN/DL process. As long as you were granted deferred action and have an EAD you are fine.

You're missing the point. Just because yours was granted for 1 year doesn't correlate with your sister's also being granted for one. One officer might see her application differently and grant her two years. That is why it is called "prosecutorial discretion."

Okay I see the link. Secondly, I will be sleeping in peace tonight thanks to you. I think you've opened some eyes slightly on this issue and it certainly makes sense to me. I'll keep this thread updated as I get more opinions but there's nothing to worry about. Thanks.

Links for me. I'll re-post anyways. Thread is called "I Got My Card!... but..." by will_con.

And you are right. Worst case scenario you just have to re-apply for your work authorization a year before everyone else.
